Submission Requirements and Approval Process for Subdivisions
The subdivision processing procedure begins with a Pre-Application conference between the developer and the Department of Planning and the Department of Engineering staff. The developer should bring a preliminary plat as described below. Smaller subdivisions of land on previously dedicated streets may qualify for a Waiver of Subdivision which classifies the development as a minor subdivision. Sections of the subdivision process may be waived for minor subdivisions as determined by the Planning Commission. Please contact the City of Paducah Department of Planning staff to schedule an Pre-Application conference and to find out if your proposed development constitutes a major or minor subdivision.
Minor Subdivision
If the development you propose consists of less than four parcels of land being created AND is served by existing streets, then you may qualify for a Waiver of Subdivision. Under this type of development, the Public Hearing Requirements are waived as well as the Preliminary Plat requirements. You will still need to follow the requirements for final plat submittal. See major subdivision for those requirements.
Major Subdivision
Preliminary Submission Of Plans And Data
As pertaining to Section 102-35 of the City of Paducah Subdivision Code, applicants must submit preliminary plans and data to the Commission that illustrates existing conditions within the site and contiguous areas that conveys the subdivider's intentions as to the proposed development's land use. Contents shall include, but not be limited to conditions as they relate to items 1-4 of section 102-35 of the Subdivision Code.
Preliminary plats should be designed to conform to Paducah Subdivision Regulation Section 102-32 that includes regulations on subdivision design standards for issues pertaining to access, conformance to major street plan and comprehensive plan, street and alley location and arrangement, minimum street and alley widths, maximum and minimum grades, vertical curves, minimum radii of curvature on center lines, tangents, intersections, blocks, and lots. Section 102-33 provides requirements for improvements to monuments and markers, streets and alleys, curbs and gutters, sidewalks, sewers, water, storm drainage, and conformance with design standards. Section 102-34 designates regulations for variances and modification of standards. These regulations should be followed with all subdivision development. Any questions should be directed the City of Paducah Planning Department.
Twelve copies of the preliminary plat should be submitted no later than 10 days prior to the next Planning Commission meeting. The Commission meets on the first and third Monday of each month at 6:00 p.m. in City Hall. Approximately two days after submission, adjacent property owners will be notified of the hearing in writing. In addition, a notice of the public hearing will be published in the Paducah Sun. The preliminary plat is reviewed by the staff of the Planning and Engineering Departments as well as the Planning Commission. Staff will make recommendations to the Commission. If the plat is not satisfactory, then the subdivider will be notified in writing the problems that need to be remedied. If the Commission is satisfied that all conditions have been met, then it will give approval of Preliminary Subdivision. Once approved, the subdivider needs to submit 12 copies of the final plat and plans to the Department of Planning by noon 10 days prior to a Planning Commission Meeting.

Your final subdivision plat should include the following information as applicable according to Sec. 102-39 subpart c, of the Paducah Subdivision Regulations:

Include the name of the subdivision.

Show the location by legal metes and bounds description.

Provide the name and certification of the registered land surveyor.
-
Show the scale graphically, providing the date and north arrow.

Clearly indicate the boundary of plat, based upon an accurate traverse with bearings and lineal descriptions.

Identify the exact location, width and name of all streets within and adjoining the plat, the exact location and widths of all alleys, and names of owners of adjoining properties.

Include city, town or county lines accurately tied to the lines of the subdivision by distances and courses, if applicable to the subdivision.

Illustrate all easements for rights-of-way provided for public services and utilities.

Provide on the plat all data on street center lines, rights-of-way, lot lines, easements, and the like in appropriate means of measurement (bearings in degrees, minutes and seconds; distances in feet and hundreds) and clearly label all monuments in such a way that any survey, description or stakeout can be performed with no additional information.

Clearly indicate all lot numbers on the plat.

Provide accurate outlines and legal metes and bounds descriptions of any areas to be dedicated or reserved for public use, indicate the intended purposes on the plat and in the dedication; and any area to be reserved by deed covenant for common uses of all property owners.

Indicate building setback lines and accurately show them with dimensions.

Include source of title with proper reference to deed books, will books and the like.

Include restrictive covenants of all types which run with the land.

Show house numbers for properties locating in the city, as obtained from the City of Paducah Engineering Department.

Provide lot areas in square feet and the total area within the boundary of the plat.

Provide certificates for approval by the Commission and the city, as appropriate.
Final Plat Approval Process
City of Paducah Departments that review plats: Planning and Engineering-Public Works
The UTILITY PLAN & PROFILE(S) is to be designed according to the Paducah Subdivision Regulations.
The STREET PLAN & PROFILES(S) are reviewed by the Department of Engineering-Public Works.
The STORM WATER MANAGEMENT PLAN is reviewed by the Engineering-Public Works Department. A Stormwater Management plan is needed if the development has 10,000 square feet of impervious area.
Concerns of Reviewing Departments:
Planning Department:
The Planning Department reviews subdivision plats for the following items:
1. That the development will be compatible with the surrounding area and uses;
2. That ingress and egress, internal traffic circulation, off-street parking and pedestrian ways shall be designed to promote public safety and convenience;
3. That the development meets all zoning and subdivision development standards; and
4. That the intent of the Comprehensive Plan has been addressed.
Engineering-Public Works Department:
The Engineering-Public Works Department reviews subdivision plans for all proposed public improvements relating to grading, drainage, floodplain management, street plans and profiles, on site improvements, and technical requirements of recorded information.
Other areas of concerns are as follows:
5. A check for proposed City projects that could affect or be affected by the development;
6. A determination of the need for a grading and drainage plan, and stormwater management plan;
7. A determination as to whether or not the site is within the 100-year floodplain and the potential impacts that the development will have on the floodplain; and
8. Appropriate notations of required improvements and plans. This would include utilities, grading, paving and drainage.
Additionally the Planning Department and Engineering-Public Works Department review subdivision plans to determine the relationship between new development and the existing and proposed City street system. The Department of Engineering is also concerned about location and width of driveways, clear-sight triangles, clear sight corridors, street light locations and other traffic safety issues.

The Planning Commission will approve the final plat after submission if all requirements are met. Following the Subdivision Code Section 102-40, the Planning Commission will sign the plat and submit a final report to the Board of Commissioners recommending acceptance of all streets and public ground. The plat will then be released upon certification of the City Clerk that the Board of Commissioners has received either a plat certificate or other approved sureties.
Plat Certificate - Section 102-41 of the Subdivision Code. A certificate submitted by the subdivider, acceptable to and approved by the City Engineer, stating that all requirements, improvements and installations to the subdivision required for its approval under the terms of this chapter have been made or installed in accordance with the said specifications.
Bond - If required, the bond will run to the city and be in an amount determined by the Board of Commissioners to cover the costs of the development. The Subdivider must be with surety by a company entered and licensed to do business in the State of Kentucky. The time for completion of improvements, monuments, and the like must be stated. The engineer and/or contractor concerned on payment of his charges for installation of the improvements, monuments, and the like must be protected. This and other requirements stated in Section 102-40 (2) or by the Board of Commissioners must be addressed.
